By accessing or using Nourii (the "Service"), operated by Punde Commerce, LLC ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Description of Service

Nourii is an AI-powered nutrition companion for plant-based eating. Our services include:

  • AI-powered meal logging and nutrition tracking
  • Photo-based food analysis and nutrition estimation
  • Personalized AI nutrition coaching
  • Restaurant discovery across 58+ cities globally
  • Meal planning and recipe recommendations
  • Progress tracking and gamification features

Account Registration

When you create an account:

  • You must provide accurate and complete information
  • You are responsible for maintaining your account security
  • You must be at least 13 years old to use the Service
  • You are responsible for all activities under your account
  • You agree to notify us immediately of any unauthorized access

Subscriptions & Payments

Free and Premium Plans

Nourii offers both free and premium subscription plans. Premium features include unlimited AI coaching, advanced meal planning, and detailed analytics.

Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Payment is processed through Stripe (web) or Apple App Store/Google Play Store (mobile apps)
  • Subscriptions automatically renew unless cancelled before the renewal date
  • Prices are listed in your local currency where available

Cancellation & Refunds

  • You may cancel your subscription at any time through Settings or your app store account
  • Cancellation takes effect at the end of the current billing period
  • Refunds are handled according to the policies of your payment provider (Stripe, Apple, or Google)
  • We do not provide prorated refunds for unused portions of a subscription period

AI-Generated Content

Nourii uses artificial intelligence to provide nutrition estimates, coaching, and recommendations. You acknowledge that:

  • AI-generated nutrition estimates are approximations and may not be 100% accurate
  • AI coaching is for informational purposes only and is not medical or professional dietary advice
  • You should consult healthcare professionals for medical conditions or specific dietary needs
  • Restaurant and menu information is provided as-is and may not reflect current offerings
  • We continuously improve our AI but cannot guarantee accuracy in all cases

User Content

You may submit content to Nourii, including meal photos, reviews, and lists. By submitting content:

  • You retain ownership of your content
  • You grant us a license to use, display, and process your content to provide the Service
  • You represent that you have the right to submit the content
  • You agree not to submit content that is illegal, harmful, or violates others' rights
  • We may remove content that violates these terms at our discretion

User Conduct

You agree not to:

  • Use our services for any unlawful purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt our services
  • Submit false, misleading, or harmful information
  • Use automated systems to access our services without permission
  • Abuse AI features or attempt to circumvent rate limits
  • Impersonate others or misrepresent your identity
  • Harass, abuse, or harm other users or our staff

Account Termination

  • You may delete your account at any time through Settings
  • We may suspend or terminate accounts that violate these terms
  • Upon termination, your data will be deleted according to our Privacy Policy
  • Active subscriptions should be cancelled before account deletion to avoid continued billing

Intellectual Property

All content on Nourii, including text, graphics, logos, icons, and software, is the property of Punde Commerce, LLC and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission. The Nourii™ name and logo are trademarks of Punde Commerce, LLC.

Third-Party Services

Nourii integrates with third-party services including payment processors, map providers, and AI services. Your use of these services is subject to their respective terms. We are not responsible for the content, accuracy, or practices of third-party services.

Health Disclaimer

Nourii provides nutrition information and tracking tools for general wellness purposes. Our services are not intended to diagnose, treat, cure, or prevent any disease. The information provided is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or qualified health provider with any questions about a medical condition or dietary changes.

Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, secure, or error-free. Nutritional information, restaurant data, and AI recommendations are for informational purposes only and may contain inaccuracies.

Limitation of Liability

To the fullest extent permitted by law, Punde Commerce, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to health decisions made based on our information. Our total liability shall not exceed the amount you have paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Punde Commerce, LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your violation of these terms, or your violation of any rights of another party.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes by posting a notice in the app or sending an email. Your continued use of our services after changes constitutes acceptance of the new terms. If you do not agree to the updated terms, you should stop using the Service.

Governing Law & Disputes

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the state or federal courts located in Delaware.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
